Terms of Use (EULA)

These Terms of Use (the "Terms" or "EULA") form a binding agreement between you and MyNewSkin ("we", "us", "our") and govern your access to and use of the MyNewSkin mobile application, website at mynewskin.co.uk, and any related services (collectively, the "Service"). By creating an account, downloading, installing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use MyNewSkin. By using the Service you confirm that you meet this age requirement and that the information you provide is accurate. If you are using the Service on behalf of another person, you confirm you are authorised to do so.
2. Your account
- You are responsible for keeping your login credentials confidential and for all activity on your account.
- You must provide accurate information during sign-up and keep it up to date.
- You may delete your account at any time from Account → Delete Account inside the app. Deletion is immediate and permanent.
3. Health, beauty and AI disclaimer
MyNewSkin provides AI-generated skin assessments, lifestyle tracking and personalised product suggestions for informational and cosmetic purposes only. The Service is not a medical device and is not intended to diagnose, treat, cure or prevent any medical condition. AI scores, recommendations and skin-age estimates are best-effort guidance generated by computer-vision models and may be incorrect.
- Always consult a qualified dermatologist or other healthcare professional for medical advice, diagnosis or treatment.
- Patch-test any new skincare product before regular use.
- Stop using a recommended product immediately if you experience irritation, an allergic reaction or any adverse effect, and seek medical advice.
- Do not rely on MyNewSkin to detect skin cancer or other serious conditions. If you are concerned about a mole, lesion or change in your skin, see a doctor.
4. Subscriptions, billing and renewals
MyNewSkin Premium is offered as an auto-renewing subscription via the Apple App Store:
- Monthly — £7.99 per month
- Annual — £64.99 per year (~32% saving)
Payment is charged to your Apple ID on confirmation of purchase. Your subscription automatically renews at the end of each billing period at the same price unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time from your Apple ID → Subscriptions settings on your device, or from inside the app under Account → Subscription → Manage Subscription.
Refunds are handled by Apple under their App Store refund policy. We are unable to issue refunds directly for App Store purchases.
5. Acceptable use
You agree not to:
- upload photos of anyone other than yourself, or photos that contain illegal, obscene or infringing content;
- upload photos of minors;
- reverse-engineer, decompile, scrape, or attempt to extract the source code, AI prompts or product database of the Service;
- use the Service to build a competing product, dataset or model;
- resell, sublicense or commercially redistribute access to the Service;
- interfere with the Service, attempt to gain unauthorised access, or use it in any way that could damage, disable or impair it.
6. Your content and licence
You retain ownership of the photos, text and other content you submit to the Service ("Your Content"). You grant us a worldwide, royalty-free, non-exclusive licence to host, process and transmit Your Content for the sole purpose of operating, securing and improving the Service for you (for example, sending your selfie to our AI provider for skin analysis as described in our Privacy Policy).
We do not use Your Content to train public AI models, do not sell it, and do not share it with advertisers or data brokers. See the Privacy Policy for full details.
7. Intellectual property
MyNewSkin, the MyNewSkin logo, the app's design, code, AI prompts, scoring system and product recommendation database are owned by us or our licensors and are protected by copyright, trademark and other laws. Nothing in these Terms transfers any of those rights to you. The licence granted to you to use the app is personal, limited, non-exclusive, non-transferable and revocable.
8. Affiliate links and product recommendations
Some product recommendations link to third-party retailers (including Amazon UK and Amazon US) under affiliate programmes. If you buy a product after clicking one of these links we may earn a small commission at no extra cost to you. We only recommend products we have evaluated against the user's skin profile; affiliate revenue does not change which products are recommended.
9. Third-party services
The Service relies on third-party providers including Apple (App Store + IAP), RevenueCat (subscription management), OpenRouter and OpenAI (AI skin analysis), Resend (transactional email) and Replit (hosting). Your use of those providers is also governed by their own terms and privacy policies.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted operation. We do not warrant that the Service will be error-free, that AI outputs will be accurate, or that any specific cosmetic result will be achieved.
11. Limitation of liability
To the fullest extent permitted by law, MyNewSkin and its directors, employees and suppliers will not be liable for any indirect, incidental, consequential, special or exemplary damages, including loss of profits, data, goodwill or other intangible losses, arising out of or in connection with your use of the Service. Our total aggregate liability to you for any claim arising out of these Terms or the Service will not exceed the greater of (a) £50 or (b) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for death, personal injury caused by negligence, or fraud).
12. Indemnity
You agree to indemnify and hold harmless MyNewSkin from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or if continued provision of the Service is no longer commercially viable. Sections that by their nature should survive termination (including IP, disclaimers, liability limits, indemnity and governing law) will survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will notify you in the app or by email and update the "Last updated" date above. Continued use of the Service after the changes take effect means you accept the updated Terms. If you do not accept them, you must stop using the Service and may delete your account.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales. Subject to mandatory consumer-protection laws in your country of residence, the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
16. Apple-specific terms
The following terms apply only to use of the app obtained from the Apple App Store:
- These Terms are between you and MyNewSkin only, not with Apple. Apple is not responsible for the app or its content.
- The licence granted to you is limited to a non-transferable licence to use the app on any Apple-branded products that you own or control, as permitted by Apple's standard EULA.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the app to you (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- You and MyNewSkin acknowledge that MyNewSkin (not Apple) is responsible for addressing any claims relating to the app or your possession or use of it, including product liability, failure to conform to legal requirements, and consumer-protection or similar claims.
- You and MyNewSkin acknowledge that, in the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, MyNewSkin (not Apple) will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
